ما هو وضع الحماية الذي أحمله؟
إذا حصلت على قرار إيجابي بشأن طلب اللجوء الخاص بك، فهناك أنواع مختلفة من أوضاع الحماية:
صفة لاجئ
حق اللجوء
الحماية الثانوية
حظر الترحيل

هل يمكن أن أفقد وضع الحماية الخاص بي؟
نعم، لا يسري وضع الحماية تلقائياً إلى الأبد. فقد تفقده في بعض الحالات.
ومن الحالات التي قد تؤدي إلى فقدان وضع الحماية:
سحب وضع الحماية (Widerruf): قد يحدث ذلك إذا زال السبب الذي مُنحت بسببه الحماية. على سبيل المثال، إذا انتهت الحرب وعاد السلام إلى بلدك الأصلي.
إلغاء وضع الحماية (Rücknahme): قد يحدث ذلك إذا رأى المكتب الاتحادي للهجرة واللاجئين (BAMF) أن القرار المتعلق بطلب لجوئك كان غير صحيح. على سبيل المثال، إذا كنت قد قدمت معلومات غير صحيحة.
انقضاء وضع الحماية (Erlöschen): قد يحدث ذلك، على سبيل المثال، إذا حصلت على الجنسية الألمانية.

إذا سافرت إلى بلدك الأصلي، فقد تفقد وضع الحماية الخاص بك. وفي هذه الحالة، يقوم المكتب الاتحادي للهجرة واللاجئين (BAMF) دائماً بدراسة إمكانية سحب وضع الحماية (Widerruf).
لقد تلقيت إشعاراً بسحب وضع الحماية. ماذا سيحدث الآن؟
إذا اعتقد المكتب الاتحادي للهجرة واللاجئين (BAMF) أنه لم يعد هناك سبب يبرر منحك وضع الحماية، فسيقوم بمراجعة حالتك. ولا يحدث ذلك إلا في حالات معينة، مثل سفرك إلى البلد الذي فررت منه أو حدوث تغييرات في الأوضاع في بلدك الأصلي.
ماذا يحدث بعد ذلك؟
ستتلقى رسالة من المكتب الاتحادي للهجرة واللاجئين (BAMF). وإذا لم يكن المكتب قد قرر بعد ما إذا كان سيبدأ إجراءات سحب وضع الحماية، فستتضمن الرسالة في البداية أسئلة حول هذا الموضوع فقط. أما في معظم الحالات، فتوضح الرسالة أن إجراءات سحب وضع الحماية قد بدأت بالفعل، وتتضمن أسئلة حول الأسباب المتعلقة بذلك.
وفي جميع الأحوال، يجب عليك الرد على هذه الرسالة. فهذا أمر مهم. احصل على الدعم من أحد مراكز الاستشارة أو اطلب المساعدة من محامٍ (Anwalt oder einer Anwältin).
بعد ذلك، يراجع المكتب الاتحادي للهجرة واللاجئين (BAMF) ما إذا كان سيبدأ الإجراءات و/أو ما إذا كان سيسحب وضع الحماية الخاص بك.
وستتلقى النتيجة في قرار رسمي (Bescheid)، أي في رسالة من المكتب الاتحادي للهجرة واللاجئين (BAMF). وإذا كان القرار سلبياً، فيمكنك الطعن فيه بالوسائل القانونية المتاحة.
ما الذي يجب أن أنتبه إليه عند الانتقال إلى مكان سكن جديد؟
إذا كنت تحمل وضع حماية، فعليك الانتباه إلى أمرين عند الانتقال إلى مكان سكن جديد:
شرط الإقامة في الولاية (Wohnsitzauflage)
بعد انتهاء إجراءات اللجوء، يتعين عليك عادةً الإقامة لمدة ثلاث سنوات في الولاية نفسها. ويُسمى ذلك شرط الإقامة (Wohnsitzauflage). فإذا حصلت على وضع الحماية في برلين، فينبغي أن تبقى في برلين لمدة ثلاث سنوات. ويكون شرط الإقامة مدوناً في تصريح إقامتك أو في الملحق المرفق به.
وتوجد استثناءات لذلك، على سبيل المثال إذا كنت تعمل ضمن نطاق معين.
وإذا اضطررت إلى الانتقال لأسباب مهمة، فيجب عليك تقديم طلب عبر استمارة التواصل الخاصة بدائرة الأجانب (Kontaktformular des LEA). ومن الأمثلة على الأسباب المهمة أن تبدأ عملاً أو تدريباً مهنياً في مكان آخر.
إبلاغ مكتب معونات البطالة (Jobcenter)
إذا كنت تتلقى مساعادات من مكتب معونات البطالة ( Jobcenter )، فيجب عليك إبلاغه عند الانتقال إلى مكان سكن جديد. فقد يصبح مكتب معونات بطالة آخر مسؤولاً عنك. وإذا انتقلت من برلين دون إبلاغ مكتب معونات البطالة ( Jobcenter )، فقد تضطر لاحقاً إلى إعادة بعض الأموال.
هل يمكنني إحضار عائلتي إلى ألمانيا؟
بحسب نوع وضع الحماية الذي تحمله، تختلف شروط لمّ شمل الأسرة. وستجد لدى دليل ألمانيا (Handbook Germany) معلومات حديثة ومقاطع فيديو بلغات مختلفة حول هذا الموضوع. وإذا كانت لديك أسئلة محددة تتعلق بوضعك الشخصي، فتوجه إلى أحد مراكز الاستشارة.
كيف يمكنني الحصول على تصريح إقامة دائمة (Niederlassungserlaubnis)؟
بحسب نوع وضع الحماية الذي تحمله، تختلف الشروط المطلوبة.
إذا كنت تحمل صفة لاجئ أو لديك حق اللجوء، فيمكنك الحصول على تصريح الإقامة الدائمة (Niederlassungserlaubnis) بشكل أسرع. فإذا كنت تتقن اللغة الألمانية (مستوى C1) وتكسب ما يكفي لتأمين معيشتك، فقد تتمكن من تقديم الطلب بعد ثلاث سنوات فقط. أما إذا كانت معرفتك باللغة الألمانية أقل (مستوى A2)، فقد تحتاج إلى خمس سنوات قبل أن تتمكن من التقدم بطلب للحصول على تصريح الإقامة الدائمة (Niederlassungserlaubnis). وستجد في بوابة الخدمات (Serviceportal) جميع المعلومات المتعلقة بتصريح الإقامة الدائمة الخاص بالأشخاص الحاصلين على حق اللجوء واللاجئين المعترف بهم:
