تمديد تصريح الإقامة: ماذا علي أن أفعل إذا قارب تصريح إقامتي على الانتهاء؟
تحرّك فوراً! من الأفضل أن تبادر بالاهتمام بتمديد إقامتك قبل انتهائها بأربعة أشهر وعلى أبعد تقدير قبل ثمانية أسابيع. ويجب أن يكون طلب التمديد قد وصل إلى دائرة الأجانب (LEA) في موعد أقصاه اليوم الأخير من سريان إقامتك.
توجيه: هل انتهى تصريح إقامتك للتو؟ قدّم طلب التمديد فوراً رغم ذلك، واطلب ترتيب استمرارية الأثر القانوني (Fiktionswirkung anordnen).
إذا كان تصريح إقامتك قد انتهت صلاحيته بالفعل، فتوجه إلى مركز استشارة. إذا كان سبب تصريح إقامتك لم يعد ساريًا، فتوجه إلى مركز استشارة.

أسباب تقديم الطلب عبر الإنترنت: يمكنك الوصول إلى قائمة الأسباب من خلال الزر أدناه. اختر السبب المناسب لك. وفي الخطوة التالية يمكنك بدء تقديم الطلب عبر الإنترنت:
املأ الاستمارة الإلكترونية وقم برفع جميع المستندات. يجب تحميل جميع المستندات كاملة وبجودة واضحة كملفات PDF منفصلة! بهذه الطريقة ستحصل على رد بشكل أسرع.

استمارة التواصل
إذا لم يكن سببك ضمن قائمة الطلبات عبر الإنترنت(Liste für Online-Anträge)، يمكنك استخدام استمارة التواصل:

إذا لم تجد موضوعًا مناسبًا لحالتك، فابحث حسب جنسيتك وبحسب الحرف الأول من اسم عائلتك.
في الخطوة التالية، اختر موضوع الرسالة. يجب اختيار الموضوع "Eiliger Termin/Notfall" (موعد مستعجل/حالة طارئة) فقط في الحالات التالية:

ماذا يحدث بعد تقديم الطلب؟
تختلف فترات الانتظار بحسب الحالة. توقّع أن تستغرق العملية ما لا يقل عن شهرين إلى ثلاثة أشهر. إذا كانت هناك مستندات ناقصة، فستتواصل معك دائرة الأجانب (LEA) مرة أخرى. لا تقلق، يمكنك عندها استكمال المستندات الناقصة. لكن ذلك قد يؤدي إلى إطالة مدة اتخاذ القرار.
توجيه: تحقّق بانتظام من بريدك الإلكتروني (بما في ذلك مجلد الرسائل غير المرغوب فيها) وكذلك من صندوق البريد الخاص بك خلال فترة الانتظار.
هل لا تزال الإقامة قانونية خلال فترة الانتظار؟
بهذا التأكيد يظل تصريح إقامتك ساريًا طالما تم تقديم الطلب في الوقت المناسب. ويُقصد بذلك أن يتم تقديمه في موعد أقصاه اليوم الأخير من صلاحية تصريح الإقامة الحالي. ويُعد هذا التأكيد بمثابة وثيقة الاستمرار القانوني للإقامة (Fiktionsbescheinigung). كما تبقى اللوائح الإضافية المرتبطة بإقامتك (مثل ما إذا كان يُسمح لك بالعمل وأين) سارية كذلك. وينطبق ذلك على جميع أنواع تصاريح الإقامة .
تنبيه: لا ينطبق ذلك في حالة تصريح إقامة مؤقتة لحين الترحيل (Duldung) أو تصريح الإقامة لمقدّمي اللجوء (Aufenthaltsgestattung) أو تأشيرة الشنجن (Schengen-Visum)!
قم بإبراز وثيقة الاستمرار القانوني للإقامة (Fiktionsbescheinigung) عند الطلب في مكان العمل، أو لدى المؤجّر، أو لدى الجهات الرسمية.
كيف أحصل على الرد؟
قد يصلك القرار بشأن طلبك عبر البريد الإلكتروني أو عبر رسالة بريدية. وفي الغالب ستتلقى دعوة لموعد قريب، يمكنك خلاله الحضور إلى دائرة الأجانب (LEA)، على سبيل المثال للقيام بعملية الطلب والدفع لتصريح إقامتك الجديد. احرص على الحضور في الموعد المحدد، واظهر عند المدخل الدعوة الخطية للموعدوإلا لن يُسمح لك بالدخول.
إذا لم تتمكن من الحضور في الموعد المقترح، فيجب عليك إلغاؤه. لكن يُنصح بعدم الإلغاء إلا في حالات الضرورة، لأن الحصول على موعد جديد قد يستغرق نفس المدة التي استغرقت لحصولك على الموعد الأول.

Fiktionsbescheinigung
Mit einer Fiktionsbescheinigung kann der legale Aufenthalt in Deutschland nachgewiesen werden, bis das LEA über deinen Antrag für einen Aufenthaltstitel final entschieden hat.
Manchmal hast du keine Fiktionsbescheinigung aber für dich gilt eine ähnliche Regel: die Fiktionswirkung. Dann hast du kein offizielles Dokument, aber dein Aufenthalt in Deutschland ist trotzdem weiter legal, bis zu einer Entscheidung vom LEA.
Die Fiktionsbescheinigung bekommst du vom LEA. Du kannst sie zum Beispiel bekommen, wenn du einen Antrag auf Verlängerung von deiner aktuellen Aufenthaltserlaubnis stellst. Oder du kannst sie bekommen, wenn du ohne Visum einreisen durftest und einen Antrag auf einen neuen Aufenthaltstitel in den ersten 3 Monaten stellst.
Du bekommst sie nur, wenn du deinen Antrag rechtzeitig stellst. Das Dokument gilt nur, bis über deinen Antrag entschieden ist.
Die Fiktionsbescheinigung ist eine grüne Klappkarte. Sie heißt auch "förmliche Fiktionsbescheinigung". Du findest unten ein Bild als Beispiel.
Die Fiktionswirkung ist kein eigenes Dokument. Aber zu kannst sie nachweisen über:
- PDF-Zusammenfassung am Ende vom Online-Antrag: Wenn du einen Aufenthaltstitel vor Ablauf vom alten Aufenthaltstitel online beantragst, musst du die Bestätigung am Ende vom Antrags als PDF abspeichern. Mit dem PDF kannst du bestätigen (zusammen mit deinem Pass und deinem alten Aufenthaltstitel), dass für dich die Fiktionswirkung gilt.
- Bestätigung am Ende vom LEA-Kontaktformular: Manche Aufenthaltstitel kannst du nicht online beantragen, dann benutzt du das Kontaktformular vom LEA. Wenn du einen Aufenthaltstitel vor Ablauf vom alten Aufenthaltstitel über das Kontaktformular beantragst, musst du am Ende die Zusammenfassung als PDF abspeichern. Mit dem PDF kannst du bestätigen (zusammen mit deinem Pass und deinem alten Aufenthaltstitel), dass für dich die Fiktionswirkung gilt.

Aufenthaltserlaubnis
Mit einer Aufenthaltserlaubnis darfst du für eine bestimmte Zeit in Deutschland leben. Zum Beispiel, um in Deutschland:
- zu arbeiten
- eine Ausbildung zu machen
- mit deiner Familie zu leben
Die Aufenthaltserlaubnis ist für Menschen, die nicht aus der EU kommen.
Das Landesamt für Einwanderung (LEA) ist zuständig. Den Antrag kannst du persönlich stellen, manchmal auch online.
Der Antrag kannst du oft online über ein digitales Formular machen, wenn du zum Beispiel studieren möchtest.
Die Aufenthaltserlaubnis ist eine Plastikarte oder ein Aufkleber. Auf der Karte stehen wichtige Informationen über dich. Zum Beispiel:

Aufenthaltstitel
Ein Aufenthaltstitel ist ein offizielles Dokument. Es erlaubt dir, in Deutschland zu leben.
Es gibt verschiedene Arten von Aufenthaltstiteln. Sie können befristet oder nicht befristet sein. Zum Beispiel:
- eine Aufenthaltserlaubnis
- eine Niederlassungserlaubnis
- ein Visum
Ein Aufenthaltstitel ist für Menschen, die nicht aus der EU kommen.
Für Aufenthaltstitel in Berlin ist das LEA zuständig.
Ein Visum musst du vor deiner Einreise nach Deutschland beantragen. Das machst du bei der deutschen Botschaft.
Der Aufenthaltstitel ist meistens eine Plastikkarte. Wenn die Karte ein kleines Chip-Symbol hat, dann ist es ein elektronischer Aufenthaltstitel (eAT). Auf dem Chip sind deine Daten gespeichert. Manchmal ist dein Aufenthaltstitel auch keine Karte, sondern ein Aufkleber in deinem Reisepass. Dann hast du keinen elektronischen Aufenthaltstitel (eAT).
Auf der Aufenthaltstitel stehen wichtige Informationen über dich. Zum Beispiel:
- dein Foto
- dein Name
- dein Geburtsdatum
Oft gibt es zu dem Aufenthaltstitel ein Zusatzblatt. Da stehen wichtige Infos, zum Beispiel, ob und in welchem Umfang du arbeiten darfst.
