Продление вида на жительство: что делать, если срок пребывания скоро истекает?
Надо действовать сразу! Лучше заняться этим вопросом уже за 4 месяца или хотя бы за 8 недель до окончания срока. Самый поздний срок для подачи заявления в LEA (Земельное иммиграционное ведомство) – в последний день действия вашего текущего вида на жительство .
Рекомендация: Ваш вид на жительство уже истёк? Тогда всё равно немедленно подайте заявление на продление. Попросите, чтобы вам оформили Fiktionsbescheinigung (временное удостоверение о легальном пребывании).
Если ваш вид на жительство уже просрочен, приходите на консультацию. Если основания, по которому вам выдали вид на жительство, больше нет, приходите на консультацию.
Как записаться на приём?

В конце, скорее всего, нужно будет оплатить сбор. Для этого понадобится кредитная карта или аккаунт PayPal.
LEA (Земельное иммиграционное ведомство) проверит ваши документы и отправит вам приглашение на приём.

Если вашего вопроса нет в списке для онлайн-заявлений, вы можете воспользоваться контактной формой:
Выберите правильный отдел LEA . Сначала посмотрите, есть ли специальный отдел по вашему вопросу. Например, есть специальные отделы по Asyl (убежищу) и Duldung (отсрочке депортации), Einbürgerung (натурализации), а также по Fachkräfte (квалифицированным специалистам), Studierende (студентам) и Auszubildende (учащимся техникумов и училищ).
Если ни одна из тем не подходит, ищите по гражданству и по первой букве своей фамилии.
Потом выберите тему сообщения. Тему «Eiliger Termin/Notfall» («Срочная запись на приём / экстренный случай») можно выбрать только в том случае, если:
- Вам срочно в течение ближайших четырёх недель нужно выехать за границу, и вы можете это подтвердить бронью.
- Без действительного документа вы потеряете работу, и у вас есть письменное подтверждение от работодателя или организации, где вы получаете среднее профессиональное образование.
- Без действительного документа вам угрожает прекращение выплат, и у вас есть подтверждение от Jobcenter (Центра занятости) или Sozialamt (Ведомства социального обеспечения).
Если ни одно из этих условий не выполнено, выберите другую подходящую тему.
Заполните контактную форму и загрузите все документы. Все сканы должны быть полными, чёткими и загружены отдельными файлами в формате PDF! Так вы быстрее получите ответ.
LEA проверит ваши документы и пришлёт вам приглашение на приём.
Есть две возможности связаться с LEA : онлайн-заявление и запись на приём через контактную форму. Зачем вам нужно в LEA ? В зависимости от причины вашего визита вам подойдёт один из этих двух вариантов.
Внимание!
После отправки онлайн-заявления или заполнения контактной формы вы получите подтверждение. Сохраните подтверждение как PDF (а не просто скриншот) и всегда носите его с собой.
Что происходит после подачи заявления?
Сложно сказать, сколько вам придётся ждать. Рассчитывайте на 2–3 месяца, как минимум. Если каких-то документов не хватает, LEA (Земельное иммиграционное ведомство) свяжется с вами ещё раз. Не переживайте – недостающие документы можно будет дослать. Но решения придется ждать ещё дольше.
Рекомендация: пока ждёте ответа, регулярно заглядывайте в электронную почту (в том числе и в папку «Спам») и в обычный почтовый ящик!
Легально ли я нахожусь в Германии, пока жду продления вида на жительство?
Если у вас есть на руках есть подтверждение о подаче заявления, ваш вид на жительство остаётся действительным, при условии, что заявление было подано вовремя. Вовремя – значит не позднее чем в последний день действия текущего вида на жительство . Подтверждение действует как Fiktionsbescheinigung (временное удостоверение о легальном пребывании). Дополнительные условия пребывания (например, можно ли вам работать, и если да, то где) тоже остаются в силе. Это касается всех статусов пребывания в Германии.
Внимание: это не относится к Duldung (отсрочке депортации), Aufenthaltsgestattung (разрешению на пребывание для просителей убежища) и шенгенским визам!
Если вас попросят, можете показать Fiktionsbescheinigung ( временное удостоверение о легальном пребывании ) на работе, арендодателю или в различных ведомствах.

Каким образом я получу решение?
Решение по вашему заявлению придёт по электронной или обычной почте. Как правило, LEA присылает вам запись на приём в ближайшее время, чтобы решить ваш вопрос (например, оформление нового вида на жительство ) на месте. Приходите вовремя и покажите на входе письменное приглашение. Иначе вас не пустят в здание.
Если в предложенное время вы не можете, обязательно отмените запись. В приглашении, которое вы получили, для этого есть специальная ссылка. Если ссылка не работает, воспользуйтесь контактной формой. Там нужно будет выбрать правильный отдел LEA . Но отказываться от записи стоит только в самом крайнем случае, потому что нового приглашения, возможно, придётся ждать так же долго, как и первого.

Fiktionsbescheinigung (certificate of fictional right of residence)
A Fiktionsbescheinigung (certificate of fictional right of residence) can be used to prove your legal stay in Germany until LEA has made a final decision on your application for a residence title.
Sometimes you do not have a Fiktionsbescheinigung, but a similar rule applies to you: the Fiktionswirkung (fictional legal effect). In this case, you do not have an official document, but your stay in Germany still remains legal until LEA makes a decision.
You receive a Fiktionsbescheinigung (certificate of fictional right of residence) from the LEA. For example, you may receive one if you apply to extend your current residence permit. You may also receive one if you were allowed to enter Germany without a visa and apply for a new residence title within the first 3 months.
You only receive a Fiktionsbescheinigung if you submit your application on time. The document is only valid until a decision has been made on your application.
A Fiktionsbescheinigung is a green folded card. It is also called a "förmliche Fiktionsbescheinigung". See the example below.
The Fiktionswirkung (fictional legal effect) is not a separate document. You can prove it through a:
- PDF summary at the end of the online application: If you apply online for a residence title before your current residence title expires, you must save the confirmation at the end of the application as a PDF. Together with your passport and your current residence title, this PDF can be used to confirm that the Fiktionswirkung (fictional legal effect) applies to you.
- Confirmation at the end of the LEA contact form: Some residence titles cannot be applied for online. In that case, you use the LEA contact form. If you apply for a residence title through the contact form before your current residence title expires, you must save the summary at the end as a PDF. Together with your passport and your current residence title, this PDF can be used to confirm that the Fiktionswirkung (fictional legal effect) applies to you.

Aufenthaltserlaubnis (residence permit)
With an Aufenthaltserlaubnis (residence permit), you are allowed to live in Germany for a limited period of time. For example, you may need an Aufenthaltserlaubnis to:
- work in Germany
- do vocational training
- live with your family
An Aufenthaltserlaubnis is for people from countries outside the European Union (EU).
The Landesamt für Einwanderung (LEA) (State Office for Immigration) is responsible. You can submit the application in person, and in some cases also online.
You can often submit the application online using a digital form, for example if you want to study in Germany.
An Aufenthaltserlaubnis is a plastic card or a sticker. It contains important information about you. For example:
- your photo
- your nationality
- your passport number

Aufenthaltstitel (residence title)
An Aufenthaltstitel (residence title) is an official document. It allows you to live in Germany.
There are different types of Aufenthaltstitel. They can be temporary or permanent. For example:
- an Aufenthaltserlaubnis (residence permit)
- a Niederlassungserlaubnis (settlement permit)
- a visa
Aufenthaltstitel are generally for people from countries outside the European Union (EU).
The Landesamt für Einwanderung (LEA; State Office for Immigration) is responsible for Aufenthaltstitel in Berlin.
Appointments at LEA
You must apply for a visa before entering Germany. You can do this at the German embassy in your country.
Electronic residence title (eAT)
The Aufenthaltstitel is usually a plastic card. If the card has a small chip symbol, then it is an elektronischer Aufenthaltstitel (eAT; electronic residence title). Your data is stored on the chip. Important information about you is written on the residence title. For example, your:
- photo
- name
- date of birth
Sticker
Sometimes, your Aufenthaltstitel is not a card, but a sticker in your passport. In this case, you do not have an elektronischer Aufenthaltstitel (eAT).
What do I need to pay attention to?
Often, you also receive an additional document with your Aufenthaltstitel. It contains important information, such as whether you are allowed to work and what kind of work you are allowed to do.
