Какой у меня статус защиты?
Вы получили положительное решение по вашему заявлению о предоставлении убежища? Тогда у вас один из этих четырёх статусов защиты:
- Flüchtlingseigenschaft (статус беженца по Женевской конвенции);
- Asylberechtigung (право на убежище по ст. 16a Основного закона Германии);
- Subsidiärer Schutz (субсидиарная защита);
- Abschiebeverbot (запрет на депортацию).

Могу ли я потерять свой статус защиты?
Да, статус защиты не даётся раз и навсегда. В определённых ситуациях вы можете его лишиться.
Вот основные случаи, когда статус защиты может быть аннулирован:
- Отзыв защиты: это может произойти, если вы больше не нуждаетесь в защите. Например, потому что война в вашей стране закончилась и наступил мир.
- Отмена решения: это может случиться, если BAMF (Федеральное ведомство по делам миграции и беженцев) сочтёт своё положительное решение ошибочным. Например, если в прошлом вы предоставили ложные сведения.
- Утрата статуса: например, если вы получаете немецкое гражданство.
Это важно
Если вы поедете в свою страну, вы можете потерять статус защиты. В таких случаях BAMF всегда проверяет возможность отмены своего решения.
Я получил(а) письмо о лишении защиты. Что теперь будет?
Если BAMF (Федеральное ведомство по делам миграции и беженцев) решит, что в настоящее время больше нет оснований для предоставления вам статуса защиты, оно пересмотрит ваше дело. Это происходит только в некоторых случаях. Например, если вы ездили в страну, из которой бежали. Или если ситуация в вашей стране изменилась.
Что будет дальше?
- Вы получите письмо от BAMF . Если ведомство ещё не уверено, нужно ли запускать процедуру лишения вас статуса защиты, в письме сначала будут только вопросы к вам. Однако чаще всего в письме сообщается, что процедура лишения защиты уже начата. В этом случае в письме вам тоже будут задавать вопросы.
- Вам обязательно нужно ответить на это письмо из BAMF . Это очень важно. Обратитесь за помощью в консультационный центр или к адвокату.
- Затем BAMF проверяет, стоит ли начинать процедуру и (или) отзывать ваш статус защиты.
- Вы получите Bescheid (официальное решение) от BAMF бумажным письмом. Если решение будет не в вашу пользу, вы можете его обжаловать.
Обратитесь в консультационный центр. Действуйте быстро, потому что сроки очень короткие!
Что нужно учитывать при переезде?
Если у вас статус защиты и вы хотите переехать, вам нужно помнить о двух вещах:
Ограничение в праве выбора места жительства
После рассмотрения вашего прошения об убежище вы, как правило, должны в течение 3 лет проживать в той же федеральной земле. Это называется «Wohnsitzauflage» – ограничением права выбора места жительства. Если вы получили статус защиты в Берлине, вы должны оставаться в Берлине в течение 3 лет. Информация об этом вносится в ваш вид на жительство или в Zusatzblatt (дополнительный лист) к нему.
Возможны исключения, например, если вы работаете определённое количество часов.
Если вам необходимо срочно переехать по веским причинам, вы должны подать заявление через контактную форму LEA. Веской причиной считается, например, работа или Ausbildung (профессиональное обучение) в другом городе.
Информация в Jobcenter
Если вы получаете пособие от Jobcenter (Центра занятости), вы обязаны сообщить туда о переезде. Возможно, после переезда за вас будет отвечать другой Jobcenter . Если вы уедете из Берлина и не известите об этом Jobcenter , в будущем вам, возможно, придётся возвращать полученные выплаты.
Могу ли я забрать свою семью в Германию?
Условия для воссоединения семьи бывают разными. Это зависит от вашего статуса защиты. На сайте Handbook Germany вы найдёте актуальную информацию и видеоматериалы на разных языках. Если у вас есть конкретные вопросы, приходите на консультацию.
Как получить Niederlassungserlaubnis (постоянный вид на жительство)?
В зависимости от вашего статуса защиты требования могут различаться.
Если у вас есть Flüchtlingseigenschaft (статус беженца) или Asylberechtigung (право на убежище), вы можете быстрее получить Niederlassungserlaubnis (постоянный вид на жительство ). Если вы очень хорошо знаете немецкий (на уровне C1) и зарабатываете достаточно, чтобы самостоятельно себя обеспечивать, вы сможете подать заявление уже через 3 года. Если же вы ещё не очень хорошо говорите по-немецки (на уровне A2), до подачи заявления на Niederlassungserlaubnis вам придётся ждать до 5 лет. Если у вас субсидиарная защита, вы достаточно хорошо владеете немецким языком (на уровне B1) и достаточно зарабатываете, вы можете подать заявление на постоянный вид на жительство через 5 лет.
