İltica başvurun hakkında olumlu bir karar aldıysan, farklı koruma statüleri vardır:
- Mülteci statüsü

Koruma statümü kaybedebilir miyim?
Evet, koruma statüsü otomatik olarak her zaman kalıcı değildir. Bazı durumlarda kaybedebilirsin.
Koruma statüsünü şu durumlarda kaybedebilirsin:
- Geri alma: Koruma nedenin ortadan kalkarsa olabilir. Örneğin ülkende savaşın bitmesi ve yeniden barışın sağlanması gibi.
- İptal: BAMF , iltica başvurunla ilgili kararın yanlış olduğunu düşünürse olabilir. Örneğin yanlış bilgi verdiğin tespit edilirse.
- Sona erme: Örneğin Alman vatandaşlığı alırsan bu durum gerçekleşebilir.
Önemli
Menşei ülkene seyahat edersen, koruma statünü kaybedebilirsin. Bu durumda BAMF her zaman iptal ihtimalini değerlendirecektir.
Bir iptal mektubu aldım. Şimdi ne olacak?
BAMF , koruma statün için artık bir neden olmadığını düşünürse, durumunu inceler. Bu sadece belirli durumlarda olur. Örneğin, kaçtığın ülkeye tekrar gittiysen ya da ülkenizdeki durum değiştiyse.
Sonra ne olur?
- BAMF ’tan bir mektup alırsın. Eğer BAMF henüz koruma statünün geri alınması için bir süreç başlatıp başlatmayacağına karar vermediyse, mektupta önce bununla ilgili sorular yer alır. Çoğu zaman ise mektupta zaten bir geri alma sürecinin başlatıldığı yazılıdır. Bu durumda mektupta nedenlerle ilgili sorular bulunur.

- Sonucu bir karar mektubu ile öğrenirsin. Karar olumsuzsa, buna karşı yasal yollara başvurabilirsin.
Taşınırken nelere dikkat etmeliyim?
Bir koruma statün varsa, taşınmak istediğinde iki şeye dikkat etmen gerekir:
Wohnsitzauflage (İkamet mükellefiyeti)
İltica sürecinden sonra genellikle üç yıl boyunca aynı eyalette yaşaman gerekir. Buna ikamet yükümlülüğü denir. Koruma statünü Berlin’de aldıysan, üç yıl Berlin’de kalman gerekir. Bu bilgi oturum izninde veya

Koruma statüne bağlı olarak, aile birleşimi için farklı gereklilikler vardır. Handbook Germany adresinde çeşitli dillerde güncel bilgiler ve videolar bulabilirsin. Durumunla ilgili özel soruların varsa, bir danışmanlık seansına gidebilirsin.
Süresiz oturma iznini (kalıcı oturumu) nasıl alabilirim?
Hangi koruma statüne sahip olduğuna bağlı olarak farklı şartlar geçerlidir.
Flüchtlingseigenschaft (mülteci statün) veya Asylberechtigung (iltica hakkın) varsa, Niederlassungserlaubnis (kalıcı oturum iznine) daha hızlı geçebilirsin. Eğer Almanca dil seviyen iyi ise (C1) ve geçimini sağlayacak yeterli gelir elde ediyorsan, bazen 3 yıl sonra başvuru yapabilirsin. Eğer Almancan daha düşük seviyedeyse (A2), kalıcı oturum izni için başvurman 5 yıl sürebilir.

Eğer ikincil koruma statün varsa, Almancayı yeterli düzeyde konuşuyorsan (B1) ve geçimini sağlayacak kadar gelir elde ediyorsan, 5 yıl sonra kalıcı oturum izni (Niederlassungserlaubnis) için başvuru yapabilirsin.
