Welchen Schutzstatus habe ich?

Wenn du eine positive Entscheidung zu deinem Asylantrag bekommen hast, gibt es verschiedene Arten des Schutzstatus: 

  • Flüchtlingseigenschaft
  • Asylberechtigung
  • Subsidiärer Schutz
  • Abschiebeverbot

Kann ich meinen Schutzstatus verlieren?

Ja, der Schutzstatus gilt nicht automatisch für immer. Du kannst ihn in bestimmten Situationen verlieren. 

Das sind Möglichkeiten, wie du deinen Schutzstatus verlierst:

  • Widerruf: Das kann passieren, wenn der Grund für deinen Schutz weg ist. Zum Beispiel weil ein Krieg beendet und in deinem Herkunftsland wieder Frieden ist. 
  • Rücknahme: Das kann passieren, wenn das BAMF heute die Entscheidung zu deinem Asylantrag falsch findet. Zum Beispiel, weil du falsche Angaben gemacht hast. 
  • Erlöschen: Das kann zum Beispiel passieren, wenn du die deutsche Staatsangehörigkeit bekommst.

Wichtig

Wenn du in dein Herkunftsland reist, kannst du deinen Schutzstatus verlieren. Das BAMF prüft dann immer einen Widerruf.

Ich habe ein Widerrufsschreiben bekommen. Was passiert jetzt?

Wenn das BAMF denkt, dass es aktuell keinen Grund mehr für deinen Schutzstatus gibt, prüfen sie deinen Fall. Das passiert nur in bestimmten Fällen. Zum Beispiel, wenn du in das Land gereist bist, aus dem du geflohen bist. Oder sich die Situation in deinem Land geändert hat.

Was passiert dann?

  1. Du bekommst einen Brief vom BAMF . Wenn das BAMF noch nicht sicher ist, ob es ein Verfahren zum Widerruf von deinem Schutzstatus einleiten will, stehen in dem Brief erstmal nur Fragen dazu. Meistens steht aber in dem Brief, dass es schon ein Verfahren zum Widerruf gibt. Dann stehen in dem Brief Fragen zu den Gründen.
  2. Auf diesen Brief vom BAMF musst du in jedem Fall antworten. Das ist wichtig. Hole dir Unterstützung bei einer Beratungsstelle oder Hilfe von einem Anwalt oder einer Anwältin.
  3. Das BAMF prüft dann, ob es ein Verfahren einleitet und/oder ob es deinen Schutzstatus widerruft.
  4. Das Ergebnis bekommst du in einem Bescheid, also in einem Brief vom BAMF . Wenn die Entscheidung negativ ist, kannst du dagegen Rechtsmittel einlegen .

Was muss ich beachten, wenn ich umziehe?

Mit einem Schutzstatus musst du zwei Dinge beachten, wenn du umziehen willst:

Wohnsitzauflage

Nach deinem Asylverfahren musst du normalerweise drei Jahre im gleichen Bundesland wohnen. Das nennt man Wohnsitzauflage. Wenn du in Berlin deinen Schutzstatus bekommen hast, dann sollst du drei Jahre in Berlin bleiben. Die Wohnsitzauflage steht dann in Deinem Aufenthaltstitel oder in dem Zusatzblatt zum Aufenthaltstitel

Es gibt Ausnahmen, zum Beispiel wenn du in einem bestimmten Umfang arbeitest.

Wenn du aus dringenden Gründen umziehen musst, musst du einen Antrag über das Kontaktformular des LEA stellen. Ein dringender Grund ist zum Beispiel, dass du eine Arbeit oder Ausbildung woanders startest. 

Mitteilung ans Jobcenter

Falls du Geld vom Jobcenter bekommst, dann musst du schreiben, wenn du umziehst. Es kann sein, dass dann ein anderes Jobcenter für dich zuständig wird. Wenn du aus Berlin wegziehst und dem Jobcenter nicht Bescheid gibst, dann musst du später vielleicht Geld zurückzahlen. 

Kann ich meine Familie nach Deutschland holen?

Je nachdem welchen Schutzstatus du hast, gibt es andere Voraussetzungen für den Familiennachzug. Bei Handbook Germany findest du aktuelle Informationen und Videos auf verschiedenen Sprachen. Wenn du konkrete Fragen zu deiner Situation hast, dann komme in eine Beratung. 

Wie kann ich einen unbefristeten Aufenthalt (Niederlassungserlaubnis) bekommen?

Je nachdem welchen Schutzstatus du hast, gibt es andere Voraussetzungen. 

Wenn du die Flüchtlingseigenschaft oder die Asylberechtigung hast, kannst du schneller in die Niederlassungserlaubnis wechseln. Wenn du die deutsche Sprache beherrschst (Sprachniveau C1) und genug Geld für deinen Lebensunterhalt verdienst, kannst du vielleicht schon nach 3 Jahren einen Antrag stellen. Wenn du noch nicht so gut Deutsch sprichst (Sprachniveau A2), kann es 5 Jahre dauern, bis du die Niederlassungserlaubnis beantragen kannst. The Counselling Centre for Migrants, which has existed since 1981, and the Welcome Centre Berlin, which was founded in 2016, were merged in April 2021.

Al Muntada supports migrants of Arab descent living in Berlin. Many of them come from Lebanon, Syria and Iraq. The counselling is aimed at people of all ages and takes place in Neukölln.
