Discrimination in Daycare and School

Discrimination can also happen in daycare centers and schools, for example through prejudice, exclusion, or unequal treatment. However, daycare centers and schools should be places where all children and young people can learn and develop equally. That is why there are legal protections and support services available here as well.

What Rights Do Children, Young People, and Parents Have?

  • Grundgesetz (Art. 3) (Basic Law (Article 3)): All people are equal before the law – including children and young people in educational institutions.
  • Schulgesetz (School Law): Children and young people have the right to learn at school without discrimination. This right is set out in the Berliner Schulgesetz (§ 2 SchulG Berlin). This means that daycare centers and schools must ensure that all children and young people are treated fairly. No one may be disadvantaged, for example because of their origin, religion, language, disability, gender, or for other reasons. If bullying or discrimination occurs, the school or daycare center must take the situation seriously. They must review complaints and try to find a solution. In doing so, they must protect the affected children and young people.

What Are Examples of Discrimination?

  • Children and young people are disadvantaged because of their origin, language, religion, gender, sexual identity, or disability.
  • They experience degrading comments, exclusion, or receive less support from teachers or educators.
  • Grades are not always fair when prejudice plays a role.
  • Children with disabilities cannot participate everywhere or do not receive enough support.
  • Language barriers are not taken into account and lead to disadvantages.

What Can I or My Child Do if Discrimination Occurs?

  • Document the situation: Write down the date, place, people involved, what happened, and, if possible, any witnesses.
  • Talk about it: Speak with teachers, daycare staff, school or daycare management, or trusted persons about what happened.
  • Seek external counseling: An independent counseling center can support you, accompany you, and help clarify the next steps.
  • File a complaint : Use the school's complaint procedures, contact the parents' representative, or reach out to the school supervisory authority.
  • Seek legal advice: In some cases, discrimination may have legal consequences. Seek advice at an early stage.

Protect children from discrimination!

KiDs is a project of the Fachstelle Kinderwelten/ISTA in the INA gGmbH.

KiDs offers counselling and support in Berlin in cases of discrimination affecting children between the ages of 0 and 12.

KiDs advises on all areas of life in which children can be affected by discrimination, such as:

  • Child day care facilities
  • transition from nursery to school
  • primary school
  • after-school care/all-day care,
  • Recreational and sports activities
  • Offices and authorities
  • health care/offers

    ...and many other areas of life.

The counselling service is aimed at adults who have taken on the responsibility of protecting children from discrimination - i.e. parents and guardians, caregivers, educators, teachers and other educational professionals.
